In reference to the item posted on the Home Page I found this account which is in variance with all the other reports of this item!

Police fine trucking company more than $84,000

SUMMIT MILLS — Pennsylvania State Police stopped eight commercial vehicles hauling components for windmills that had improper special hauling permits. They issued 50 citations with fines totaling more than $84,000.

Sgt. Roger Pivirotto, Somerset station commander, said the state police were not aware of the site going in along Rockdale Road near Rockwood until they received calls from residents.

Two days ago, a citizen, who used to be a truck driver, called state police and said the superloads were being moved on Mount Davis Road in Summit Township after dark, which is illegal. A state police trooper went to the wind farm site, but the tractor-trailer had already arrived.

“I contacted an individual at the site and issued a verbal warning,” Pivirotto said. “He assured me the complaints were not legitimate.”

Calls to the wind farm site for comment were not returned. Casselman WindPower LLC of Richmond, Va., filed the plans to erect seven turbines in Summit and Black townships, according to the county planning commission. The project is being constructed by PPM Energy, Oregon.

The sergeant contacted the commercial vehicle enforcement team out of Greensburg. They, along with troopers from the Somerset station, went to the area Thursday afternoon. One tractor-trailer hauling a base tower was stopped.

As troopers were inspecting the vehicle, six more vehicles arrived. Because it takes several hours to inspect each tractor-trailer, additional enforcement officers were called in from Somerset and Greensburg. While the troopers were coming here from Greensburg, they located another tractor-trailer with a similar load on Route 219.

Transport Bellemare International Inc., Trois-Rivieres, Quebec, Canada, owns all eight vehicles.

They had had improper permits that were confiscated, Pivirotto said. They were overweight, over width, over height and had numerous out-of-service violations. They were not being escorted by state police as required for superloads. Fifty citations were issued. The fines total $84,295, not including court costs.

“They stopped the first vehicle between 2 and 3 p.m., and it took until midnight to finish,” the sergeant said. “They had to wait until daybreak to allow them to go. Troopers escorted them one-by-one to the site. There are stringent laws about superloads because that’s hundreds of thousands of pounds. If that load should fall off, or if someone else was traveling at night and didn’t see it coming, it would be a disaster. It’s absolutely a safety issue. That’s why superloads require police to escort them to warn people. Oversize loads do not require a police escort.”

Because the road is two lanes and is a winding road, a detour was set up until the loads could be safely escorted after dawn on Friday.

“They are some very reputable firms,” Pivirotto said. “I talk to ATS Wind Energy Services almost daily. They have two sites near Stoystown and Berlin. Any time we’ve found anything, they make every effort to correct any problems. They have every intention to comply with regulations.”

NOTICE THAT THIS REPORT MENTIONS THAT THE DRIVERS DID HAVE PERMITS BUT THAT THESE WERE INCORRECT FOR THE TASK! ALSO THESE PERMITS WERE SEIZED PROBABLY AS EVIDENCE FOR WHAT WILL PROBABLY BE AN EVENTUAL COURT CASE! THIS IS A MUCH DIFFERENT CONNOTATION TO THE REPORTS THAT SAY THEY DID NOT HAVE PERMITS! I have no connection with that company and have never driven for them. I do wonder if there was some difficulty for these French Cdns understanding the English legal terminology outlining the permit requirements and why would experienced drivers that have years of driving in to and across Pa. not realize they need State Trooper Escorts for OD loads on all highways in the Keystone? If this was some executive decision to try to short cut the system and make an extra big profit on this contract, it is the kind of decision that has bankrupted many others in the past. Some people never learn by others mistakes!

My point was that the reporting by numerous sources all except one gave a false impression that there were no permits issued. Now it is apparent that the company applied for and received the incorrect type of permit that would allow the trucks to proceed unescorted which is cheaper of course. That move should be just cause for a dismissal in the office hierarchy at Bellemare. Also knowledgeable drivers should have refused these loads if they read the permits completely. This is a serious offense and could even affect the insurance policies and their ability to trans-border/import loads. Who do they think they are anyway......Mexicans?

I have never heard of any permit for load's such as this to be able to run after dark or unescorted. As far as I know there is no such permit. The permit comapny should also be investigated to see excatly what info the Bellmare gave them to create such a permit.

Good for you Dave.
I went to work last night & ck'd the list of co's Transforce own's. I thought they were one of our's. They are. :yikes: Knowing Transforce, head's have already been hacked off.
No one @ work had heard about this, & damn near sh!t when I told them what went down.
I can see them either closing the door's or the suit's have gone in & cleaned house from top to bottom. Telling them they didin't understand the permit's as they were in english, won't wash.

The permits was issued by the State of Pensylvania, they were up to date, and alright for that load. BUT, the state made a mistake and put the wrong serial number on the permits. This is where it go crap. I question myself why Belmare didn't check their Permit before sending their drivers down, it's their mistake, but it's not worth a fine of 84000$ The companie boss will go in court to contest de case.

It's really surprising, but don't think that Bellmare will go down, they just brought SRS transport in Ste-Catherine, QC. It's another cie that do oversised load.

There's one drive that got filed because he don't have a good English, i'm really curious what's are their critera for giving that fine. I bet that the driver was just really nervous, and made sure to understand the policeman to be sure that he donesn't give a wrong answer.

That is very interesting! I once got a fine for $9600.00 approx for not having a registration for Pennsylvania when I picked up recycle cardboard just South of York. The local yokel said that the State Troopers had just trained him and his colleagues about commercial vehicles and that the Governor had sent them out to collect the millions in unpaid registrations and fines owed to the commonwealth of Pa. He did not accept the IFTA registration as being the reciprocity. Then he wanted to talk about hockey because his new next door neighbor was that most hated referee in the NHL! So I obliged with my stories of when Don Cherry and brother used to work beside me! When I got back to Toronto with the notice of the infraction my boss Harvey K. went beserk! That Ukrainian Hewbrew actually phoned the Governor of Pa! and had the ticket withdrawn on the threat of a major lawsuit! I did not have to post any surety so I was laughing all the way back to T.O. via N.J. and N.Y! That cost some extra miles that I never got paid for!
